Book Description: The United States and many other nations are experimenting with responses to terrorism. Terrorism and the Law is a new casebook that considers various different anti terrorism measures that governments have devised and the domestic and international legal principles that may constrain these measures. This casebook emphasizes major terrorism cases and events in both the United States and abroad. It is an introductory text suitable for all law students, with no pre requisites required. Chapters 1 through 4 concern the use of the criminal justice system to respond to terrorism. They address the problem of defining terrorism, the extra territorial application of criminal laws, the problem of making evidence public, and many other issues that have arisen in terrorism prosecutions. Chapters 5 and 6 cover two important civil responses to terrorism, immigration controls and sanctions.Chapter 7 through 19 address military responses to terrorism. They deal with authority to use military force against suspected terrorists, military detention and interrogation of suspected terrorists, the military trial and punishment of suspected terrorists, and other related topics. Finally, chapters 20 and 21 consider civil remedies that victims may seek.
